Marin Institute Model Statute Now Available
A bill that follows through on New Mexico state Attorney General Gary King’s proposal to ban alcoholic energy drinks has been introduced in the state’s legislature.
The legislation (House Bill 36) was introduced by Representative Ray Begaye (D) and would “prohibit the manufacturer, distribution, and sale of flavored malt energy beverages containing stimulants.” The bill also bans importation of such products.
The legislation comes on the heels of the recent victory secured by 13 state attorneys general (including New Mexico) and the San Francisco city attorney’s office that forced MillerCoors to remove stimulants from its leading product, Sparks.
This bill, which is partly based on model legislation provided by Marin Institute, would eliminate the entire dangerous category by banning any remaining products from smaller companies and preventing new brands from entering the market.
